Terms of Service

1. Introduction and acceptance

These Terms of Service ("Terms") govern your access to and use of ClipWhim, an AI image-to-video web service available at https://mischief1.com (the "Service"). ClipWhim is operated under the laws of the People's Republic of China (mainland China). "ClipWhim", "we", "us" and "our" mean the operator of ClipWhim.

By creating an account, subscribing to a plan, purchasing credits or otherwise using the Service, you confirm that you: (a) are at least 18 years old; (b) have read and agree to these Terms; (c) agree to our Privacy Policy and Acceptable Use Policy; and (d) are authorized to accept these Terms for yourself or any organization you represent. If you do not agree, do not use the Service.

ClipWhim is an independent product. It is not affiliated with, endorsed by or sponsored by The Biological Computing Co. (TBC), fal, or any other AI model provider.

2. Service description

2.1 What we provide

ClipWhim lets you upload a still image, describe the motion in a text prompt, and generate a short (3–5 second) AI-generated video clip that you can download as an MP4. The Service is a digital software-as-a-service product delivered over the internet. All videos it produces are AI-generated.

2.2 Nature of the service

The Service is digital and intangible. After a payment is confirmed, credits or plan access are added to your account immediately. Because delivery is immediate and digital, specific limits apply to refunds, as described in Section 7.

2.3 Underlying AI models and providers

Videos are generated with the Mischief 1 image-to-video model created by The Biological Computing Co. (TBC), which is built on Alibaba's open Wan 2.2 model. We access the model through the third-party API of fal (fal.ai). Output quality, speed and availability depend on these providers and may change; we will try to communicate significant disruptions in a timely way.

3. Accounts

You need an account to generate videos. You are responsible for activity under your account and for keeping your login secure. Notify us immediately at support@mischief1.com if you suspect unauthorized use.

4. Plans and credits

Generations are paid for with credits: 1 credit = 1 second of 480p video; 720p uses 2 credits per second. Current plans and prices are always shown on our Pricing page:

• Free: 20 credits on Google sign-up, no payment required. Accounts created with email and password do not receive sign-up credits.
• Starter Pack: a one-time purchase of 200 credits for $9. Not a subscription; it does not renew.
• Creator: $19 per month (600 credits each month) or $190 per year (7,200 credits each year). Subscription that renews automatically.
• Pro: $49 per month (1,600 credits each month) or $490 per year (19,200 credits each year). Subscription that renews automatically.

Credits have no cash value, cannot be transferred, and do not expire while your account is open. Credits included in a subscription are added at the start of each billing period and carry over to later periods.

5. Billing and payment

5.1 Payment processor and merchant of record

Our order process is conducted by our online reseller and merchant of record, Waffo Pancake (operated by Waffo.com Limited). Waffo Pancake processes payments, handles billing, issues receipts and invoices, and handles payment-related customer service and refunds for purchases made on ClipWhim. Payment card data is processed by Waffo Pancake and is never stored on our servers.

5.2 Subscription recurring billing authorization

By subscribing to the Creator or Pro plan, you expressly authorize recurring charges to your payment method for the plan price shown at checkout (monthly or yearly, as you choose). Your subscription renews automatically at the end of each billing period until you cancel in accordance with Section 6.

5.3 One-time credit purchases

Each Starter Pack purchase is a single, one-time charge for the amount shown at checkout. It does not renew.

5.4 Prices and taxes

Prices are listed in US dollars. Applicable taxes (such as VAT, GST or sales tax) may be calculated and added at checkout by Waffo Pancake depending on your location; the final amount is always shown before you pay.

5.5 Billing errors

If you believe a charge is wrong, please contact us at support@mischief1.com before disputing it with your bank. We aim to respond within 2 business days and to resolve confirmed billing errors within 5 business days.

6. Cancellation

You can cancel a subscription at any time:

• Online (recommended): sign in and go to Settings → Billing → Cancel subscription.
• Email: send a cancellation request from your account email to support@mischief1.com.

Cancellation stops future renewals. It takes effect at the end of the current billing period: you keep plan access and all credits you already received until then, and you will not be charged again. Credits bought separately (Starter Pack) are not affected by cancelling a subscription.

7. Refunds

Our full Refund Policy is part of these Terms. In summary:

• Failed generations are refunded automatically as credits.
• Unused purchases: a full refund is available if you request it within 14 days of purchase and have not used the credits from that purchase.
• Duplicate charges or billing errors are refunded in full.
• Verified service outages within our control lasting 72 hours or more are eligible for a pro-rated credit or refund.
• Credits that have been used are generally not refundable, and credits used for content that violates our Acceptable Use Policy are never refunded.
• Statutory rights (for example, withdrawal rights in the EU/UK) are preserved where applicable law grants them.

Refunds are issued by Waffo Pancake to the original payment method.

8. Acceptable use

Your use of the Service must follow our Acceptable Use Policy, which lists prohibited content (including pornography/NSFW, violence and gore, hate speech, child-unsafe content, deepfakes and impersonation of real people, and copyright or trademark infringement), how we moderate, how to report content and how we enforce. You may only upload images you own or have permission to use, and you must not upload photos of another person without their consent.

9. Your content and outputs

You keep whatever rights you have in the images and prompts you submit ("Inputs"). You grant us a limited, non-exclusive license to process your Inputs solely to provide the Service. We do not use your Inputs to train AI models.

Subject to these Terms and the model provider's terms, you may use the videos you generate, including for commercial purposes. You are responsible for how you use them and must disclose that they are AI-generated where the law or the platform you publish on requires it. AI output can be inaccurate or unexpected, and similar output may be generated for other users.

10. Prohibited uses of the Service

You must not: reverse engineer or scrape the Service; resell or share account access; attempt to bypass content filters, rate limits or credit accounting; or use inputs, outputs or model responses to train or develop a competing AI model.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR ACCURACY OF AI OUTPUTS. We do not guarantee that a generation will succeed, meet your expectations or be available at all times.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

13. Suspension and termination

We may suspend or close your account if you materially breach these Terms or the Acceptable Use Policy, if we suspect fraud or abuse, or if the law requires it. Credits used for violating content are not refunded. If we close your account for reasons other than your breach, we will refund any unused prepaid period and unused purchased credits. You may delete your account at any time by contacting support@mischief1.com.

14. Changes

We may update these Terms. We will notify you of material changes by email or on the site at least 14 days before they take effect. Continued use after the effective date means you accept the updated Terms. If any provision is unenforceable, the rest remains in effect.
